OPD arrest 11- and 13-year-olds in connection with scooter theft, death of father

Oakland police arrested an 11-year-old and a 13-year-old in connection with a scooter robbery that led to the deadly shooting of a father the day after Christmas.

Oakland police on Thursday held a news conference to announce the arrests of the minors. The 13-year-old was charged with robbery and the 11-year-old has not been charged because of his age, police said.

Police said they reviewed a lot of video surveillance to help them figure out what happened to Ponciano "Chano" Bernal, 48, who was shot and killed on Dec. 26 on the 1100 block of Foothill Boulevard just before 4:15 p.m.

Police said he had confronted three boys who stole his son's scooter.

The alleged shooter, a 15-year-old, was arrested and charged with murder earlier this month.

A boy who identified himself as Dylan described what happened to his father in a GoFundMe post. He said he saw his father shot in the heart and die right in front of him. He said he had told his dad about the stolen scooter, and urged him not to confront the boys. 

Lt. Gloria Beltran called what happened a "very unfortunate situation."
