Suspect, father and son shot in Pittsburg officer-involved shooting
PITTSBURG, Calif. (KTVU) - An investigation is under way in Pittsburg, after three people were shot by a Pittsburg police officer.
According to Pittsburg Police, officers responded to the 1500 block of Kingsley Drive around 9 p.m. for a domestic disturbance call.
A woman had called 911, saying her son, 20-year-old Rigoberto Gutierrez, was acting irrational and was most likely under the influence of drugs.
When officers arrived at the home they found the son on the porch. He was armed with a gun, and had pointed it at his father several times, according to police.
“[She] says he was pointing a firearm at his father and family inside the residence," said Pittsburg Police Capt. Ron Raman. “The officers asked him to show his hands. He refused to and reached for that firearm," said Raman.
Police said they feared for their lives and that they shot the son in his leg when he reached for his gun, which was in his waistband, according to police.
Police say at least two rounds went through the screen door where the suspect's father and 17-year-old brother were standing. The father was shot in the stomach and the brother was shot in the leg. All three were taken to the hospital.
Pittsburg Police said the two officers were unaware two family members were standing directly behind the screen door when officers opened fire on the suspect.
The 17-year-old is being treated and is in stable condition, while the father was treated and released.
The suspect is expected to survive.
“This is a shock," said Gutierrez's aunt Janet Gutierrez. "My sister-in-law Marina, she’s a stay-at-home mom; takes care of the children. They’re just loving parents, so I don’t know why this happened.”
Neighbors said they knew the boys as friendly and polite. Pat Swanson, who babysits at the neighbors house, said Gutierrez told her he received bad news recently, but was otherwise in a pleasant mood.
“He’s a nice kid," said Swanson. "The other day I asked him, ‘What are you doing?’ He goes, ‘I just got laid off from my job.’ I said, ‘I’m sorry.' He still smiled at me and was very polite."
Police say they're waiting on toxicology reports to see if Gutierrez was under the influence of drugs. According to police, the suspect will be taken to County Jail when he's released from the hospital.
The officer involved in the shooting has 20 years experience in law enforcement.
This incident is being investigated by the Pittsburg Police Department and the Contra Costa District Attorney's Office.
